Question:
What about the new law passed in IN effective 7-1-00??

I just got denied by my HMO. They state that obesity treatment is an "exclusion". I thought the new law meant that they could no longer do that. What's up?    — Cynthia G. (posted on August 10, 2000)

I have the same problem and hoped that the new law would help. When I called the Indiana Department of Insurance today they indicated that the key word in the law was "Offer" to your employer. If your employer does not take up the offer to include this in their insurance there is nothing you can do regarding the law. The law lacks protecting insureds against discrimination by employers. I am going to appeal because this is a medical necessity for me. The exclusion is like saying they will cover whatever anybody else needs to be healthy but if you are obese just go ahead and die. Also, there is a difference between being obese and morbidly obese.
