Ot: What is Litigation?

Our personal injury attorney is telling us something about litigation in regards to our settlement from our car accident back in Oct. We were run off the road by another vehicle. My car was totalled. Adam my hubby was off work 3 months, had 3 bulging disc, had to have plasma disc decompression done before he could go back to work, all of us had to see our family doc and chiro for months. Long story short we were told a month or so ago that they would be sending a first offer on Adam soon. They haven't so our attorney has said that her litigation dept is looking into our case. What the heck does litigation mean? Thanks Ange

Litigation means they are looking to see if it better to settle (make you an offer) or fight it in court. I would ask your attorney to find out what is going on with each lawsuit. They should have one for each person that was injured and one for property loss...which should have been settled first since its the easiest. Oh they paid me for my car back in Oct not long after it happened. It was a 98 Dodge Neon so they didn't pay much but they gave me what it was worth. They've made a first offer on myself, my daughter and my father in law. But we aren't accepting that. We were waiting to see what they'll do with Adams since his is going to be more complicated than ours. Thanks

Ok...then they are making it sound like they want to take it through the courts. Or are trying to intimidate you with the thought of having to go to trial. Insurance companies hate to pay....anything!
