Employer wrote the policy with exclusion for WLS. Anyone appealed and won?

Had failed VBG in 1986. Trying to get approved for Distal RNY. Had all pre-testing done. United Health Care turned me down due to exclusion put in policy by husbands employer. Want to fight employer! Do I have a chance? Anyone in this situation?
