    Sick Leave...E.I.

    Hi Guys,
    First of all sorry so many threads....I just have a ton of questions about lots of stuff...any

    E.I. Questions....

    We don't have short term disability at work (cheap *****s)....anyway has anyone here dealt with E.I. for sick benefits?


    1. I've got like a few sick days left....should I take them or does that get taken of my EI benefit....

    2. I'm getting my Record of Employment Monday..should I put in the claim before I get my surgery?

    3. I've got a letter from the hospital saying I need to be off for 6-8 weeks...is there anything else I need?

    Hey Bill...I am on EI now from when I had my surgery. So I will try and answer what I can.

    1) I would take them just so you don't loose them.

    2) You get up to 15 weeks on EI for sick benefits. SO I would file on the last day of work. Remember you have a 2 week waiting period before you will receive anything.

    3) Nope I think that's all you will need. Just keep the letter with you. You can file on-line and don't need to go into a Service Canada. They may ask for the letter later so just keep it safe for now.(see below)

    Question for you... Can they do your ROE on line and send it right to Service Canada?!?! If not you will have to go in to file your claime.  My job was able to send it right to service Canada ( they sent me a hard copy)

    as far as the sick pay I won't lose it if I don't use it..but if I do take it..will that money be take off or hold me back as far as the waiting period..I know it sounds confusing....

    I believe if you take your sick pay, it's like vacation pay and they may hold back some of the EI.I was laid off in late fall and they were supposed to give me my vacation pay 4 weeks before the lay off but the accounting chick screwed up and threw it all on my last cheque so my waiting time ended up being 4 weeks instead of 2.  If you are not going to lose your sick days then I'd not bother and just do your 2 weeks of waiting on EI and then save those days as you may need them later.
    I believe any money(s) have to be declared as income even during your waiting period. But who claims a few days. I wouldn't. Your last day of physically working, should be your last day.

    Hi Bill,

    I hav not had my surgery yet, but did have to apply for sick leave thsi past February.  I did not have to serve the 2 week waiting period.  They explaind that becasue i had exhaustd my sick days at work, the 2 week period would be waived.  It mase no censeto me, but i did'nt argue.

    Depending on how you feel about it, you may not need that much time.  If it is a physical job, thats a completely different story.  I don't get sick days, so I took  a 1 week  vacation and went back to my desk job without a problem.

    Thanks pal...I work an office job ..but what the Hell I'm gonna take 6 weeks so I can get adjusted and yah...f)(* it! Im worth it :)
    Hehe, I'm sure you are!  Enjoy your adjustment time!  (You know that time when you are feeling well enough to work, but don't have to)!  If I had, had sick time, I might have taken longer, but I doubt it.  I stupidly have always gone back before I was due to.

    My understanding is that you need to use up your sick time through work first before applying for EI. You can apply for EI on-line but don't count on your employer filing your ROE electronically. I don't believe that they are obligated to do so. Many big companies do but even a big corporate hospital I worked for didn't file them electronically so you will need to get a paper copy to send to EI. It is best to have a copy for your records anyway. For sick benefits you don't need to show them proof that you are off for medical reasons until after 9 weeks. Just FYI since you won't be off that long anyway. After that the doctor needs to fill out a form. I went back to work after 3 1/2 weeks, I didn't have that much sick time and I couldn't afford to go on EI. You might not be off that long, it depends on your job. If you are at a desk job 3-4 weeks will probably be long enough but if you have a physically demanding job then probably you will need the 6-8 weeks. I have heard of people going back to work after 4 days! It all depends on you and your recovery rate.

    Can I ask, when did you get the letter saying that you need to be off for 6 - 8 weeks?  which hospital? 
    i was under the impression that the recovery time was 6 - 8 weeks and have communicated this to my employer from the beginning.  I have heard that many go back earlier but I guess some don't as well so it really depends.  I had planned on the 8 weeks and I do have 100% coverage at work for up to 13 weeks so there is no downside for me but I do feel very fortunate especially after I read that many don't have STD coverage.

    I work for SunLife and they paid me for my first two weeks off, the rest EI covered. Found out last week when I got sick that the two weeks SunLife paid was ALL the sick time I have from when I started last year until next year.

    So now if i get sick, it's unpaid. They said EI won't pay sick leave if they have sick days with the company left.

    Ridiculous.
        
     important tidbit of advice:

    use your sick days. 
    apply for EI as usual but ensure that your ROE indicates that your last day of pay is sick leave pay
    Request EI WAIVE your waiting period as you have exhausted your sick leave

    yes WAIVE. 

    They will waive it if your last paid time is sick leave and it has been exhausted.

    OMG you are great.....so all I do is ask the ask the HR department to indicate the last day of pay is sick pay...great..thanks so very much!
    How many hours do you have to have worked in order to qualify for sick leave thru EI?

    I only work as a casual and I was off on a years mat leave from August 2010 till August 2011. I don't have many hours accumulated since then.
