Question:
I need to fill out FMLA paperwork but wanted to have my PCP fill out, not the surgeon

The company I work for is bad about keeping peoples info confidential even if you request this so I do not want the weight loss surgeon to fill out my FMLA papers because I am a nurse & work in a facility where her name is known so word would get out what type of surgery I am having, but my PCP says that he cannot fill them out because he does not know the info. I am not embarrassed in any way about the surgery-there are just people at work that I don't care for them to know my business. Any ideas?? Thank you!    — lovemybebes (posted on September 5, 2011)

It is illegal for your company to release this information to anyone. It violates HIPAA laws and they can be sued and fined by the government. When it comes to your paperwork, the physician that is actually doing the procedures has to complete it. There really is not a way around that part. Finally, the ones you don't want to know you are going to have the surgery will know sooner or later when the pounds drop like flies. But just remind your HR people that it is a legal issue if they release Any information about you or your procedure without your signed consent.

Unfortunately your surgeon will need to do the paperwork for fmla, not really a way around that. Howwver as the other poster mentioned, it is illegal for your employers to let any of that information "slip" without your express permission which must be validated by your signature. Anything that they release without that can and should lead to federal court, lawsuit by you, and huge fines imposed. Best of luck!
