Question:
Which states cannot exclude surgery deemed medically necessary?

I have read that five states, because of legislative mandates, cannot deny procedures which are deemed medically necessary. One state I heard was Virginia. Does anyone know which states fall in this category, and where can this information be verified?    — Marianne D. (posted on March 27, 2004)

I'm not sure on the states, however it's my understanding that the state is regulating that the health insurance company must make it an available benefit to all employers. There is no mandate though that an employer must purchase that particular benefit. I hope I'm wrong!

I'm not positive but I believe that Maryland is one of those states...I'd be interested in finding out...I lived in MD when I had my surgery but now I live in Florida and would love to see the law changed here too!!

I believe Tooter is right, it's not a mandate that the employer purchase the WLS rider. I seem to remember it had something to do with the number of employee's a company had. For example, if a company employed less than 50 employees they didn't fall into the category of companies who have to follow that particular guideline.
