Was Denied Need Any Info I can Get to Fight This!

I was just denied by my insurance for WLS. There is a written Exclusion in the contract. I am appealing now and I am looking into getting a Lawyer....I could use any info on how others got there insurance to pay especially if they had a written exlcusion in there contract. Thanks everyone for taking the time to help out a peer!    — EvningStar81 (posted on May 16, 2002)

Do they specifically exclude WLS for morbid obesity or just a general exclusion of all weight loss? Either way, the best approach is going to be from the aspect of your weight related co-morbibities. Do you have sleep apnea, type 2 diabetes, high blood pressure, joint problems, etc. Although they may try to exclude WLS for just loosing weight, they legally can't deny you treatment for your co-morbidities. And if your doctor recommends WLS as the best treatment for those health problems, especially if they are serious, debilitating or life treatening, then you should have a pretty good case at getting approved. I would recommend Walter Lindstrom at obesitylaw.com. His rates are very reasonable (my appeal only cost $350) and was worth every cent. Good Luck.
