Question:
How can I get my previous PCP's office to release my medical records?

My PCP changed practices and now she can't get the old one to release my records. My surgeon has also requested them. I went to the office myself yesterday and was told to sign a release (now my 3rd one) and the wait would be 3 weeks....and call first to check even then if they are ready...I feel this is a stalling tactic due to my PCP's patients leaving this practice for the new one....Does anyone know my legal rights in this matter? The practice is in Huntington WV.    — Donna M. (posted on May 30, 2002)

You are legally entitled to your own medical records. You need to send a letter requesting these records, and send it CERTIFIED MAIL. At the bottom of your letter, cc: your attorney. I guarantee, you will get a response. If not, take the practice to small claims court!
