HELP! They want to deny me FMLA saying WLS "Is just a cosmetic Procedure."
I need some advice. I am having my surgery on December 12th, and went in today to finalize my paperwork for my FMLA. Well the my contact in HR told m y that I may not qualify for FMLA because weight loss surgery is unneccesary, and is counted just like cosmetice surgery. She said I might end up qualifying because I am MO so it could be considered medically neccesary. Well Yeah its medically neccesary and by definition isnt anyone having WLS MO? I mean who else would be having this surgery? Im not having my insides rearranged so I can lose those last peky five pounds. And just in my oppinion, but isnt this medically neccesary for all of us? I mean why else would my insurance, and my Surgeron approve me to have this surgery? I mena when I went to my surgeon, and submittted my paperwork to my insurance they went over my medical history with me, and the medical advantages of having WLS. NOT ONCE did either of them bring up my apperance! My surgeon did not say ,"great your having WLS, well let me tell you how much better Im going to make you look!" No we talked about preventing diabetes, and heart disease (which both prevail in my family), and of getting rid of the constant lethargy, and weight related back pain, and all the other medicall reasons to have this done! Anyways I was wondering has anyone else taken FMLA when they had thier surgery? Does WLS surgery qualify for FMLA? When I first looked into WLS surgery I asked this and was told it did. If they deny me FMLA do I have some kind of legal recourse? Please help!
