HELP! They want to deny me FMLA saying WLS "Is just a cosmetic Procedure."
Although I'm not an expert on the F.M.L.A., iti is my understanding that it applies to any medical condition, treatment, or procedure that your doctor indicates you will need time off from work for .. It shouldn't matter even if it IS elective surgery (or PS) .. The doctor certifies you need th time off for the procedure and to recover form it .. Do you have any of the major co-morbids? If so, then that strengthens the claim anyway that this is not just a "cosmetic" procedure, but is being done to not only ameliorate your MO or SO condition, but to treat the co-morbids ..
If your HR is still a butt about it, I'd talk to Walter Lindstrom at the Obesity Law Advoccacy Center in San Diego and see what his office can do for you ..
