Denied as "Plan exception"

I was terminated on Aug 18, 06 from my employer.  I am currently on COBRA.  I contacted my insurance to review the "requirements".  I have followed the requirements for the LapBand.  On January 26, 2007, I was notified my insurance had a "plan exception" and Bariatric surgery in not covered.   It was not the insurance company itself but my previous employer who made the "plan exception".  I contacted the previous employer about an over-ride or exception to this rule.  The answer was a flat NO.   I am not having this surgery for fun but for health.   I (thank God) paid for the surgery myself.   I am looking for any and all recourse about my previous employer and having this right.  Is it possible to have the "plan exception" overturned?  I am on schedule for February 5, LapBand.   Thank you Cecilia

The insurance company administers the plan for your employer, if your employer says no then it's no.
