Employer Exclusion Anthem in VA

Hello everyone, After going back several years in the forum and looking, I do not see anything about the luck of someone appealing an exclusion in Virginia.  My HR department verbally told me it was excluded and so did the Insurance Company when I called them after I attended the first free seminar for the surgeon in my area.  (I have not yet asked for the exclusions in writing) I do believe in fighting and the appeal process, but I am wondering if someone (perhaps Gary V?) might be able to tell me about any luck with Virginia appeal process.  I understand it has to do with my employer not buying the rider,  and they have made it more than clear to me that they will NOT be buying it in the future.  This is all incredibly disappointing, it took enough courage just to attend the seminar, sheesh. 

Don't waste your $ on a lawyer, nothing they can do, if it's an exclusion then it won't be covered.  I have seen several appeals with exclusions in policies and not 1 was ever approved.  So sorry.
