I recently attended the NYU WLS seminar.  I'm not sure what I'm doing yet, but wanted to find out what the surgery is about.   My doctor suggested I check it out, he says I need to lose weight.  I'm pushing BMI of 40 (39.3)

That being said, NYU tells me (and all of us) to call our insurance company and find out what the requirements are for WLS.  When I call they give me NOTHING.  Tell me my doctor has to call.  What's the point?   I just don't want to go down the road of WLS being something to consider if they're going to deny me.

No diabetes (but every one of my aunts and dad have it, and all insulin-dependent)
I have high cholesterol, asthma, possible sleep apnea (looking into a sleep study at dr. suggestion). 

I have friends who have had lap band and both had to have it taken out (body rejection and leaking) and one had RNY and the other had VGS, both with success.

Please make another call to the insurance company as you may have better success with someone else.  I had the same insurance and had no difficulty getting the information directly from the company.

I think you are making a wise decision to exclude the band from consideration.  In addition to the sleeve and RNY, you should probably also consider researching the DS.

 You should go see Dr. Garber at The New York Bariatric Group , they will call your insurance company for you and verify your benefits.  You don't need to call.  They are also the best with the best staff.  Check them out.
