6 mos diet done - but new insurance has exclusion

I am so so bummed and trying to see if I have any options... my company had BCBSIL, and so I spent several months jumping through those hoops to get the 6 month medically supervised plan, all out of pocket, mind you! I finished the 6 months on October 13, had my appt with my surgeon, was ready to fight the good fight to get BCBS to approve me... but then I got notice that we were switching insurance and going to Humana as of Nov 1! I hoped against hope, but of course just learned today that the new HUmana policy specifically excludes any WLS. I am so completely bummed and I am pissed because I am sure they learned when they did the underwriting that I was int he process of getting approved...  my only q is do I have any recourse??

I had the same thing happen to me but I was very lucky that my new insurance covered wls.   But if I were you I would check into cobra with the BCBS!    you were already approved.....seems to me they have to cover you some how some way! Pam

Hi Pam, THanks for your idea. Unfortunately I was not approved with BCBSIL... they denied me as they do everyone initially, and required the 6 month diet. I had just finished that and was getting ready to submit evidence to BCBS to fight their denial when we switched.. The thing that gets me is that I know the new insurance excluded because they saw that I had been in process! I have written to obestitylaw.com to see if there is any recourse.. but I am very sad that there probably is not.  trying to have faith that I can still do this the old fashioned way... but after so many years of trying I thought I finally had an answer. but now I need a new answer apparently.. sigh

 I am so sorry that you are going through all of this. My heart does go out to you. Does your new insurance go into effect in January or are you already with Humana? OH I wish I had some sage advice and words of wisdom to give you, but all I can offer is my support....and prayers and positive thoughts. Don't give up....hang in there. ((((((HUG))))))) Paula

I am soooo sorry !   I know how you feel !   My cheap company has such crappy Aetna insurance that the exclusion was right there in my face .  I  thought I might be able to fight them with Walter Lindstrom , Obesity Law, but he says if there's an exclusion, there's not much you can do.   I see you live in Chicago, I'm about 30 miles south of Chicago.  I plan on going to LifeWeigh Bariatrics in Downers Grove & got the list of their companies that finance & by my surprise I was approved, so, on that note, that's how I am getting it done.  Try to cheer up.  Keep thinking positive, where there's a will , there's a way....what about if you cobra the old insurance ?  Tell them you don't want the new insurance  for whatevr reason & Cobra the old insurance ?  Maybe they wil let you do that ?  Just an idea ...

Not sure how big the company you work for is, but maybe you could go to HR and see what they will do, if anything.  Seems odd that a company would switch insurance in November instead of January...but I guess it could happen. Good Luck...don't go down without a fight...and if necessary, go to Mexico.  There are some good docs just south of the border that many people on the main board have used.
