wow!! Maybe I didn't ask my friend the right question...frig, I find that disgusting to think that you have to tell them, what if you work with a bunch of loss lipped people? What happened to your right to privacy? That really blows

 Yeah.  And because i worked for a smaller company, a lot of the ESA rights do not protect me.  They only usually protect companies with 50 or more employees.  So I told her my reason.. and stayed on medical leave (which wasn't paid by the company anyway) and then promptly quit after that time frame ran out.

Hi again Mark. Either the surgeon or your family doctor could write the note. I chose to ask my family doctor as I only saw the surgeon one time pre-op and that was several months before I got my date. Either one should be fine.

Hi All

I received a note which had the hospital info on it and the approx time that I would need off.  It did not say anything about the type if surgery.

mine stated that I was having a medical procedure done at the Guelph General Hospital and would require 4-6 weeks off work

Your employer MAY be able to ask you why you are off (you don't HAVE to tell them) but your surgeon/physician CANNOT tell your employer the reason you are off unless you give them written permission to do so. 

I work in a surgeons office and our typical work notes is something like "Bla-Bla will be off work _________ to ________ for valid medical reasons and can return to work ___________ with no restrictions"

If your surgeon or physician writes your work note and includes the procedure you are having without your permission, I would contact the College of Physicians and Surgeons.

In Ontario it is against the law for your employer to require information on your diagnosis and treatment. They can only request the following;

If the cir****tances are such that it is reasonable for the employer to require the employee to provide a doctor's note, the employer can ask only for the following information:

  • The duration or expected duration of the absence,
  • The date the employee was seen by a health care professional,
  • Whether the patient was examined in person by the health care professional issuing the certificate.

Employers are not allowed to require information about the diagnosis or treatment of the medical condition of the employee.

This comes directly from the Ontario Ministry of Labour and applies to all workplaces with 50 or more full-time employees.

 Yes.. 50 or more employees :)  I worked with 20,, ESA does not support a lot of employees who work for smaller companies

For anyone who is on paid medical leave, once you go into short term disability (which you do after 3 days/21 hours in most cases), you then deal directly with your insurance provider.  I have had to do this twice in my 15 yrs at my employer.  You will/should still get a paycheque via your employer, but the insurance is reimbursing them.

When you fill out the insurance co's forms, your doctor must specify the reason for being off - which, since he/she is filling them out for you/on your behalf, you are, in effect, giving permission for him/her to do so.  As far as I know, insurance companies do have the right to ask, since that's how they base their payments to you.

Also, if you do tell HR, they cannot disclose it to anyone else in your workplace.  Being in HR has strict confidentiality regulations attached to it - any HR.  The only ones who should know at your job are those you choose to tell.
