Where do I go from here??? HELP!

never take no for an answer..... write an appeal.   Ask your doctor for advise.

I can not believe they denied you for 2 pt shy from 50.  I swear these insurance companies make me sick.  Fight Fight Fight.  Do not take no for answer

Dig out your insurance book, does it say that in there, or did you get a letter stating that you needed to have a BMI of 50 or above?  You should do a "shout Out" on the DS board for Diana Cox, she is AWSOME & might be able to help with the 50 or above thing.  Does the insurance say that the DS is "investigational" with people of BMI's less than 50?

I know this might be bad advice but I say eat your way to 50 and resubmit again.  What is 10 to 15 pds when it comes to your life.

The insurance lady just e-mailed me. She said we will have to submit an appeal because if I intentionally gain weight, I could still get denied.

first of all, why would she email you saying that?  did you ask that question, if you did shame on you.    she is a moron, unless she follows you around there is NO way that could be proved, that is one of the stupidist things I have heard, and I have heard of a lot,  if the medical policy states you have to have a bmi of 50 to qualify for a DS, then that may be a tough one to go in with a bmi of 48, but gosh darn it, as a SMO statistically it is a matter of time to go from a bmi of 48 to 50.......

I didn't e-mail her telling her I was going to gain 10 pounds intentionally, I told her I may have gained since my last weigh in. Its possible. I can gain and loose 10 pounds in a matter of days. She basically told me insurance would think it was intentional, which makes sense, I would think that as well.

I just don't understand the denial because in the policy, it states that they will look at the weight within the last 2 years b/c of course, BMI fluctuates. I had a BMI of up to 52 in the last 2 years. Its almost like they didn't look at that information. In which case, they should when they get my appeal. I'm hoping.

don;t give up, if you don't have a clause against 1x surgery for wl, that is better, now that 48 to 50 bmi, i could have gained 10 lbs in a couple of weeks.  try to read your policy very closely, especially what you posted above about the last 2 years?  no it doesnt make sense.  again don't give up..... good luck in your revision
