FMLA Coverage????
Can anyone tell me if my employer can turn me down for FMLA coverage because they say this type of surgery is not covered?? I meet all time and hours worked and have already given my notice of need 30+ days in advance of my surgery. I just was told today that my employers insurance company told my supervisor (also HR person) that they don't cover this? I have down loaded the employees guide to FMLA from the US Dept of Labor Wage and Hour Division and it doesn't say anything about an insurance company approval?
My health insurance has already approved me and I have 101 hours of Vac/Sick time to use so I am covered for two weeks with pay...
I am doing some more research for amunition...I already told them I will fight this decision...I just wanted to know if anyone had any advice for me?
I see my surgeon Friday the 21st and will request a certification of medical necessity from him then...but should I be doing anything else.
It is clear to me that this employer doesn't have my best interests and I am sure that in the near future I will be seeking other employment..but I will need to be here for awhile yet...
I have never heard of anything being denied FLMA. In FLMA that I know about, they don't pay you, they just can't fire you when you take the time off. There are limits regarding time and notices ect but I think they are wrong. Are you talking about a short term disability policy that is going to pay you when you are out. that would be totally different than FLMA.

I know, crazy right...I am totally talking about FMLA...it sounded to me like my supervisor/HR Person confused FMLA with short term disability...WHICH WE DON"T HAVE...I will be going over her head tomorrow....I have printed out the Dept of Labor guide and read thru the entire thing...highlighted the points...and also printed out Fact Sheet #28 which describes the eligibility requirements...and highlighted those items that pertain to my situation.
I truly believe my supervisor is a very unhappy person who takes it out on those around her. She must have her own thing going on...well I won't make excuses for her....
I am sure once I prove my point things will resolve itself...but to go through this is just not fair to me...but I will do what I must...
I don't think there are restrictions on FMLA about what type of medical need you have. I know my surgeons office filed the FMLA paperwork for me but I ended up not needing it. My company didn't have to abide by the FMLA laws because they don't have 50 employees within the mile radius, although they said they would treat my situation like it was FMLA even know they didn't have to. I would just take them the info and tell them they are wrong! I hope it all works out for you!
